In addition to physical abuse, people can also be accused of financial elder abuse as well. Because the elderly population is at risk for having their finances deceptively manipulated, law makers and law enforcement take these crimes very seriously are willing to pursue harsh penalties.

Case Study: Monterey County client investigated by FBI for taking funds from his mother-in-law in Iowa.

A local building contractor, whose aged mother-in-law lived in a small town in Iowa, was investigated by State of Iowa officials as well as the FBI for alleged financial elder abuse, particularly investing some of her funds (for which he had a power of attorney) in questionable hedge fund vehicles. We engaged lawyers in two cities in Iowa and travelled twice to Iowa, the second time meeting with special agents of the FBI and two Assistant United States Attorneys, in an effort to demonstrate that no financial elder abuse had been committed. As a result of these trips and hard work, no charges were ever filed against our client.

Case Study: Real Estate Broker acquitted of financial elder abuse by jury.

At Biegel Law Firm, we once defended a real estate and mortgage broker who was accused of financial elder financial abuse, i.e. improperly taking hundreds of thousands of dollars from elderly clients in unsound investments. The case was tried before a Monterey County jury and received a substantial amount of publicity in the local press. Our firm used a private investigator who was able to locate a number of helpful witnesses and many of the supposed “victims” testified on our client’s behalf. Originally charged with 13 felonies, the matter proceeded to a jury trial where the trial judge dismissed two of the counts and the jury found our client not guilty of the remaining 11 felony counts.
